INJURYTRAK TERMS OF SERVICE
Effective date: October 20, 2026
These Terms of Service (“Terms”) govern your access to injurytrak.com and the InjuryTrak software, websites, and related services provided by InjuryTrak, a trade name of ChiroTrak LLC (“InjuryTrak,” “we,” “us,” or “our”). By using the website or services, you agree to these Terms. If you use InjuryTrak through an organization, that organization’s agreement may also apply.
1. THE SERVICE
InjuryTrak provides software and related services that help professional customers receive, organize, manage, and work with accident-report and related information. Features may change over time. Some features require an account or a separate subscription or service agreement.
2. ACCOUNTS AND AUTHORIZED USE
You must provide accurate account information, keep your login credentials secure, and promptly notify us of suspected unauthorized access. You may use the service only for lawful business purposes and in accordance with these Terms, applicable law, and any agreement with your organization. You may not misuse, disrupt, reverse engineer, or attempt unauthorized access to the service or its systems.
3. CUSTOMER DATA AND RESPONSIBILITIES
You or your organization retain responsibility for information submitted to or managed through the service, including ensuring that you have the rights, permissions, notices, and consents required to collect, access, use, and communicate about that information. You are responsible for the accuracy of information you enter, your account users, and your compliance with applicable privacy, consumer-protection, telemarketing, and text-messaging requirements. Do not use the service to send unlawful, deceptive, or unsolicited communications.
Information available through InjuryTrak may include data obtained from public records or other sources. Such information may be delayed, incomplete, or contain errors. You are responsible for independently confirming information before relying on it for a decision or contacting an individual. InjuryTrak is a software provider and does not provide legal, medical, insurance, or professional advice.
4. TEXT MESSAGES
If you separately opt in to receive text messages from InjuryTrak, we may send the message types described when you provide consent, such as demo scheduling and reminders, customer support or account-related notices, or promotional messages if separately selected. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Text consent is not a condition of purchasing or using the service. Your text opt-in is governed by our Privacy Policy. Carriers are not liable for delayed or undelivered messages.
5. FEES AND SUBSCRIPTIONS
Fees, billing terms, renewal, and cancellation for paid services are set out in your order or subscription agreement. If these Terms conflict with a signed customer agreement, the signed agreement controls for that conflict. You are responsible for applicable taxes and charges stated in your order.
6. INTELLECTUAL PROPERTY
InjuryTrak and its licensors own the service, software, design, and related materials, except for customer data and third-party materials. We grant you a limited, non-exclusive, non-transferable right to use the service during your authorized subscription, subject to these Terms and your customer agreement. You may not copy, resell, or distribute the service except as expressly permitted in writing.
7. THIRD-PARTY SERVICES
The service may rely on or link to third-party services and data sources. Those services are governed by their own terms and policies. InjuryTrak is not responsible for third-party services or information outside our control.
8. AVAILABILITY AND DISCLAIMERS
We work to keep the service available and secure, but do not promise uninterrupted or error-free operation. To the extent permitted by law, the website and services are provided “as is” and “as available,” without warranties not expressly stated in a written customer agreement. Nothing in these Terms limits rights or remedies that cannot lawfully be limited.
9. LIMITATION OF LIABILITY
To the extent permitted by law, InjuryTrak will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, or loss of data arising from use of the website or service. Any liability limits in a separate written customer agreement will control for that customer. These Terms do not exclude liability that applicable law does not allow us to exclude.
10. SUSPENSION OR TERMINATION
We may suspend access where reasonably necessary to protect the service, comply with law, or address a material violation of these Terms or a customer agreement. Your organization’s subscription terms govern termination of paid access. Provisions that by their nature should continue after access ends will survive.
11. CHANGES AND GOVERNING LAW
We may update these Terms by posting a revised version here and updating the effective date. Continued use after the change takes effect means you accept the revised Terms. These Terms are governed by Ohio law, except where another law must apply.12. CONTACT
